WHAT WE DO

GoodHub.com provides an “online meeting place” and platform for UK registered organisations to communicate with their community and the public, and to promote and increase awareness of their organisation, its activities, initiatives and projects, and planned events. Organisations can also raise finance for their charitable activities and sell tickets to their events.

The services provided by GoodHub include validation of organisations wishing to register on GoodHub.com, the verification of the ID of the principal applicant for the organisation, the provision of advice and support on communication and fundraising strategies for organisations and fundraisers, distributing and promoting an organisation’s online profile, campaign, event and fundraiser pages hosted on GoodHub.com. We also manage the collection of Gift Aid from HMRC and the distribution of funds to beneficiary non-profits with reconciling data.

WHAT WE DON’T DO

Although we may promote, advertise or raise awareness of certain organisations, campaigns, events or fundraisers, we will not be involved in the management of or use of donations, participation (entrance) fees or ticket sale proceeds. If an organisation offers an incentive or reward in relation to any fundraising campaign or event, GoodHub will not directly offer or fulfil these.

Other than as mentioned above, we do not have any involvement in any arrangements organisations, users and fundraisers make with each other through GoodHub. The arrangements made between organisations, fundraisers and users are solely private and are made directly between the individual parties concerned. Accordingly, when using GoodHub, organisations take full responsibility for their arrangements with fundraisers and donors whom they contact and the nature, terms and extent of their arrangements with them and obligations to them.

We do not verify the identity of anyone who becomes a user or fundraiser. We cannot therefore give any guarantee that any users or fundraisers are who they say they are or that the information they provide is accurate, complete or true.

We make no recommendation or representations in relation to any organisation, their campaigns or events, or their fundraisers’ initiatives.

FUNDRAISER TERMS

These Fundraiser Terms set out the fundraiser’s and GoodHub Platforms Limited’s obligations with respect to the fundraiser’s use of GoodHub.com.

In addition to these fundraiser terms, the fundraiser agrees to other terms when using GoodHub.com.

REGISTERING WITH GOODHUB.COM

The fundraiser can only register a fundraising page if the organisation has registered on GoodHub. If your preferred organisation has not registered then you may provide sufficient information that GoodHub can contact the organisation in order to notify it that you would like to fundraise for that organisation. If the organisation subsequently chooses to register, GoodHub will notify you.

By registering on GoodHub, you confirm that you have read and that you understand the advice provided by The Fundraising Regulator “Setting up an online fundraising appeal: advice for the public”.

ACCESS TO AND USE OF GOODHUB.COM

The fundraiser’s username and password provide access to the fundraiser’s area of GoodHub.com.

FUNDRAISER DETAILS

The names and address of the fundraiser will be provided for GoodHub Platforms Limited for its records.

GoodHub Platforms Limited has complete discretion to accept or reject the fundraising application. The decision to accept or reject an application is final and there is no obligation on GoodHub Platforms Limited to share its reasons for its decision.

YOUR NOMINATED BENEFICIARY ORGANISATION

The fundraiser can register and create a fundraising page on behalf of one or more organisations registered on GoodHub.

If your preferred organisation has not registered, then you may still be able to create a fundraising page to raise funds on its behalf. You will be required to provide sufficient information that GoodHub can contact the organisation and invite it to register on GoodHub and/or provide bank and Gift Aid details in order that GoodHub can transfer funds raised and submit Gift Aid claims to HMRC on its behalf.

THE FUNDRAISER’S FUNDRAISING PAGE

The fundraiser’s fundraising page contains information submitted by the fundraiser, including a video clip, where the fundraiser has opted to submit such a clip. The fundraiser’s name and fundraising page are viewable by potential Donors on GoodHub.com.

By starting the listing, the fundraiser confirms to GoodHub Platforms Limited and the donors that the information contained in the fundraiser’s fundraising page is complete, accurate and up to date.

DISTRIBUTION OF FUNDS RAISED AND GIFT AID CLAIMS

Funds raised on behalf of an organisation through your fundraising page will be distributed directly to that organisation in accordance with our Organisation Terms and Conditions. In no circumstances will GoodHub transfer funds raised to the fundraiser.

RE-APPROPRIATION OF DONATIONS

If we are unable to transfer donations made via your fundraising page to your preferred charity or non-profit for any reason whatsoever, then GoodHub may re-appropriate the relevant funds at its discretion. Circumstances include but are not limited to:

  • a charity or non-profit is registered on GoodHub but has not provided its bank details within twelve months after registration, or
  • where the nominated recipient charity or non-profit is NOT registered with GoodHub at the point of donation and subsequently chooses not to register on GoodHub or provide bank details for the transfer of funds within twelve months after the date that the donation is made.

For this section, the right to “re-appropriate funds” shall mean the right for GoodHub to use or apply the relevant monies as GoodHub determines at its sole discretion including, without limitation, making donations to other charities or non-profits, enhancing other donations, or for its internal business purposes (including retaining the funds).

FEES

There is no charge to register and submit a fundraising campaign (“sub-campaign”) application and if your request is eligible and approved then there is no upfront charge for listing on GoodHub.com.

Funds raised through the fundraiser’s sub-campaign are aggregated to the organisation’s lead fundraising page. The organisation may incur fees on funds raised through your fundraising page. See Organisation Terms and Conditions for more information.

There are no additional charges for the organisation or the fundraiser for sub-campaigns.

You solely are responsible for ensuring that you have gained the appropriate permission of any of and all the individuals and premises, venues and similar captured in images or videos (or any link to the same) that you submit to GoodHub for your page. If you do not have permission, then you should immediately remove that published content from GoodHub.com.

The licence shall terminate automatically on expiry or termination of these Terms of Service or the removal of your GoodHub.com crowdfunding page from the website in accordance with these Terms and Conditions.

CONFIDENTIAL INFORMATION

During the published period of your GoodHub.com page and for a period of seven (7) years thereafter, the parties shall treat as strictly confidential all information about the other which has been acquired as a result of the use of the website and associated services and which is not in the public domain.

No party shall use or disclose to any third party such information belonging to the other party without that party’s prior written consent, except where required to do so by applicable law, including, without limitation, the Freedom of Information Act 2000 and the Environmental Information Regulations 2004, or regulatory or governmental body. This paragraph shall survive termination of these Terms and Conditions.

TERMINATION

GoodHub Platforms Limited reserves the right, at its sole discretion, to immediately and without notice suspend or permanently deny your access to all or part of the website and associated services, including for example by removing any GoodHub.com fundraising page from the website. GoodHub Platforms Limited will only exercise this right where there is a breach or suspected breach by you of these Terms and Conditions (including where there is any actual or suspected fraudulent, criminal or improper use of the website or associated services) or where GoodHub Platforms Limited has any other legitimate reason to do so.

These Terms and Conditions shall terminate automatically upon the removal by you or GoodHub Platforms Limited of your GoodHub.com fundraising page from the website. These Terms and Conditions will continue to apply to past use by you.

Upon termination or suspension or denial of access to the website and associated services, funds already received on the organisation’s behalf by GoodHub Platforms Limited will be handled in accordance with the provisions above, provided that any potential payment (where applicable) may be delayed where GoodHub Platforms Limited conducts an investigation regarding your use of the website and associated services and GoodHub Platforms Limited may decide to refuse to pay funds across to the organisation where you have breached these Terms and Conditions or your GoodHub.com fundraising page has been removed. In such circumstances GoodHub Platforms Limited may authorise a refund of donations to donors.

ADDITIONAL TERMS FOR FUNDRAISERS FOR COMMUNITY INTEREST COMPANIES (“CIC’s”)

The following terms are in addition to the “Fundraiser Terms and Conditions” and apply to fundraising and event pages created by a fundraiser on behalf of a CIC through GoodHub.

THE GOODHUB FOUNDATION

All CIC’s registered with GoodHub are automatically allocated to The GoodHub Foundation (“GHF”).

The GoodHub Foundation is an independent grant-making charity (registered charity number in England and Wales: 1209383) whose object is to advance such charitable purposes for the public benefit (according to the law of England and Wales) as the charity trustees see fit from time to time.

Any donation or ticket purchase made through a fundraising page published on GoodHub with a CIC as the intended beneficiary is made to The GoodHub Foundation. The GoodHub Foundation is a registered client organisation of GoodHub and as such has appointed GoodHub as its agent for dealing with donations, including, where applicable, Gift Aid, made through GoodHub.

DONATIONS AND PURCHASES

When a user donates to a CIC or purchases a ticket for an event through a fundraising page hosted by GoodHub, the donation and/or payment is made to The GoodHub Foundation. Any Gift Aid declared is claimed automatically by GoodHub on behalf of The GoodHub Foundation.

The GoodHub Foundation will transfer donations and purchase funds to the selected CIC that you have expressed a wish to support through the fundraising page that you create.

The GoodHub Foundation will have absolute discretion over the onward transmission of funds, including where applicable Gift Aid, made through GoodHub.

However, in rare cases and at its sole discretion, The GoodHub Foundation may withhold and re-appropriate donations to a CIC without prior notice or explanation if:

  • It cannot satisfactorily verify that the recipient bank account belongs to the CIC.
  • It believes the CIC does not serve a charitable purpose.
  • It suspects the donations will not be used for charitable purposes.

RE-APPROPRIATION

In the rare event that The GoodHub Foundation is unable to pass funds onto your chosen CIC, The GoodHub Foundation may forward the funds to an alternative charitable organisation, or The GoodHub Foundation may retain the funds. If funds are retained, then The GoodHub Foundation will use the funds in a manner that furthers its own charitable objects.

If donations or ticket purchases are passed to another CIC or charity, The GoodHub Foundation will make reasonable efforts to ensure that the charitable purpose of such alternative closely match the purpose of the CIC you originally created your fundraising or event page for.

GoodHub or The GoodHub Foundation will make every effort to inform you and users in the rare event that funds have been sent to an alternative organisation.
